The case of Binali Özkaradeniz and Others is an important case as
a violation decision of the Constitutional Court on environmental issues,
emphasizing the positive obligations of the state on environmental issues
and showing a different approach to the constitutional article on which
environmental issues are addressed. The resolution brought by the courts
of first instance to the dispute in question includes controversial points regarding the responsibility of administration and the constitutional
obligations of the administration regarding the protection of the environment.
Binali Özkaradeniz ve Diğerleri kararı Anayasa Mahkemesi’nin
çevresel meselelere ilişkin vermiş olduğu bir ihlal kararı olması, çevresel
meselelere ilişkin devletin pozitif yükümlülüklerine vurgu yapması ve
çevresel meselelerin ele alındığı Anayasa maddesine ilişkin farklı bir
yaklaşım sergilenmesi nedeniyle önemli bir karardır. Karara konu olan
uyuşmazlığa derece mahkemelerinin getirmiş olduğu ..züm de idarenin
sorumluluğu ve çevrenin korunmasına ilişkin idarenin Anayasal yükümlülükleri
açısından tartışmalı noktalar içermektedir.
